Terms & Conditions for Devine Travel
1. Introduction
Welcome to Devine Travel ("we," "us," or "our"). Devine Travel is a travel consultancy registered in the United States (1309 Coffeen Avenue ST 1200, Sheridan, WY 82801, USA). These Terms and Conditions ("Terms") govern your use of our website, services, and any travel arrangements booked through Devine Travel. By accessing our services, accepting a quote, or making a booking, you ("client," "you," or "your") agree to be bound by these Terms.
2. Services Provided & Agency Status
Devine Travel operates as an independent travel consultancy and booking agent arranging services between you and third-party travel providers globally, including airlines, hotels, tour operators, cruise lines, and ground transport companies ("Suppliers"). Contractual responsibility for the operational delivery of specific travel components lies with the primary Supplier.
3. Booking & Payment Policy
3.1. Quotes & Availability: All quotations provided by Devine Travel are subject to real-time availability and price fluctuations until written confirmation is issued and payment is received.
3.2. Payment Methods: To ensure optimal value and eliminate merchant fees, payments are accepted strictly via Direct Bank Transfer or Cash (by prior arrangement). We do not accept credit or debit card payments.
3.3. Non-Refundability: Unless explicitly stated otherwise in your bespoke itinerary or written quotation, all bookings, deposits, and full payments are 100% non-refundable and non-transferable once confirmed.
3.4. Price Fluctuations: Prices are subject to change prior to booking confirmation due to external factors, including fuel surcharges, currency fluctuations, or Supplier fee updates.
4. Travel Documents, Health & Insurance
4.1. Passports & Visas: Clients and their guests are solely responsible for ensuring that their passports meet all validity, blank page, and entry requirements of the countries they are visiting or transiting through, alongside securing any necessary entry visas, transit permits, or travel authorisations.
4.2. Health & Vaccinations: You are responsible for verifying and complying with all health, vaccination, and entry documentation mandated by your destination authorities.
4.3. Travel Insurance (Mandatory Recommendation): We strongly advise all clients globally to purchase comprehensive travel insurance at the time of booking. Insurance should cover emergency medical expenses, personal liability, luggage loss, travel disruption, and cancellation fees due to unforeseen circumstances. If you decline insurance, you assume full financial responsibility for any resulting losses or cancellation fees.
5. Consumer Protection & Regional Terms
5.1. Section for UK Residents & UK-Originating Travel:
Flight-Inclusive Packages (ATOL): Where your travel package includes flights booked through our primary UK ATOL-holding Suppliers (such as Trip.com [ATOL 11572] or Expedia [ATOL 5788]), your booking is financially protected under the respective principal operator's ATOL licence. An official ATOL Certificate detailing your coverage will be issued upon booking confirmation.
Non-Flight Packages (PTR): Non-flight ground packages, accommodation, or travel arrangements booked via partner networks (including Booking.com) are arranged in accordance with applicable UK Package Travel Regulations via our primary Suppliers' statutory insolvency protection measures.
5.2. Section for Non-UK & International Clients:
Global Bookings: For clients residing outside the UK or booking itineraries originating outside the UK, consumer rights, cancellation rules, and supplier protections are governed by the primary Supplier’s terms in the destination country and US agency law.
No US Sellers of Travel Registration: Devine Travel acts purely as an independent consultancy and retail agent. International clients are solely responsible for ensuring their travel insurance covers supplier insolvency and trip disruption in their home jurisdiction.
6. Responsibilities and Limitation of Liability
6.1. General Limitations: Devine Travel exercises due care in selecting reputable Suppliers but accepts no responsibility for operational defaults, negligence, or service failures by third-party Suppliers.
6.2. Force Majeure: We shall not be liable for any failure to perform contractual obligations, nor pay compensation, where failure arises from events beyond our reasonable control (including natural disasters, severe weather, war, civil disruption, industrial action, air traffic control restrictions, or government-imposed travel restrictions).
6.3. Cap on Liability: To the maximum extent permitted by law, Devine Travel's total liability for any claim arising out of your booking shall not exceed the total commission or fee earned by us for the specific booking in question.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to conflict of law principles. For UK clients booking UK-originating package arrangements, mandatory statutory rights under English law remain unaffected where applicable.
