1. Introduction
Welcome to Devine Travel ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website, services, and any travel arrangements booked through Devine Travel. By accessing our services or making a booking, you ("client," "you," or "your") agree to be bound by these Terms. Please read them carefully.
2. Services Provided
Devine Travel acts as an intermediary between you and various travel suppliers, including but not limited to airlines, hotels, tour operators, car rental companies, and cruise lines (collectively, "Suppliers"). We arrange travel bookings, provide travel advice, and assist with itinerary planning. We do not own or operate any of these Suppliers' services.
3. Booking and Payment
3.1. Booking Process: You can request travel arrangements through our website, email, or phone. We will provide you with a quote or itinerary detailing the proposed travel arrangements, including prices, dates, and inclusions.
3.2. Confirmation: Bookings are considered confirmed upon our written confirmation and receipt of the required deposit or full payment.
3.3. Payment Terms:
* Deposits: A non-refundable deposit may be required at the time of booking to secure arrangements. The amount will be specified in your quote.
* Final Payment: The remaining balance is due by a specified date, typically [Number] days prior to departure. Failure to make the final payment by the due date may result in cancellation of your booking and forfeiture of your deposit.
* Payment Methods: We accept bank transfers; other payment methods may be accepted by prior request. All payments are subject to verification.
3.4. Currency: All prices are quoted are in the currency agreed at the time of contract signing. Payment will be processed in this currency.
3.5. Price Fluctuations: Prices are subject to change due to factors beyond our control, including currency fluctuations, fuel surcharges, and supplier price increases. While we strive to provide accurate pricing, we reserve the right to adjust prices before booking confirmation. Any significant changes will be communicated to you.
4. Travel Documents and Information
4.1. Passports and Visas: It is your sole responsibility and the responsibility of your guests to ensure you/they have a valid passport, any necessary visas, and any other required travel documents for your destination(s). Passports must typically be valid for at least six months beyond your intended date of return. We can provide general guidance, but you must verify specific requirements with the relevant embassies or consulates.
4.2. Health and Vaccinations: You are responsible for checking and complying with all health and vaccination requirements for your destination(s). Consult your doctor or a travel clinic well in advance of your travel.
4.3. Travel Insurance: We strongly recommend that you purchase comprehensive travel insurance. Travel insurance should cover, at a minimum, medical emergencies, trip cancellation/interruption, lost luggage, and personal liability. We can assist you in obtaining suitable travel insurance. If you decline travel insurance, you assume full responsibility for any losses incurred.
4.4. Information Accuracy: You must provide accurate and complete information when booking (e.g., names as they appear on passports, dates of birth, contact details). We are not liable for any issues arising from incorrect information provided by you.
5. Changes and Cancellations
5.1. Client-Initiated Changes/Cancellations:
* Any changes or cancellations must be requested in writing.
* Changes: Fees may be charged by Suppliers for changes to bookings (e.g., flight dates, names, hotel stays). We will also charge an administrative fee for processing changes.
* Cancellations: Cancellations will incur fees as per the Supplier's terms and conditions, which are often non-refundable after a certain period. We will also charge an administrative fee for processing cancellations. The non-refundable deposit will be forfeited in all cancellation scenarios.
5.2. Supplier-Initiated Changes/Cancellations:
* Suppliers may occasionally make changes to bookings (e.g., flight schedules, hotel amenities, tour itineraries). We will endeavour to notify you of any significant changes as soon as reasonably possible.
* If a Supplier cancels a booking, we will assist you in seeking alternative arrangements or a refund, as determined by the Supplier's policies.
* We are not liable for any consequential losses or expenses incurred by you due to Supplier-initiated changes or cancellations.
6. Itinerary and Inclusions
6.1. Details: The itinerary provided at the time of booking outlines the services included in your travel package. Please review it carefully.
6.2. Exclusions: Unless explicitly stated in your itinerary, the following are generally not included: visa fees, vaccinations, travel insurance, meals not specified, drinks, personal expenses, tips, and gratuities.
7. Responsibilities and Liabilities
7.1. Our Role: Devine Travel acts as an agent for our Suppliers. We exercise care in selecting reputable Suppliers, but we do not guarantee their performance or services. We are not responsible for the acts or omissions of the Suppliers or any third parties involved in your travel arrangements.
7.2. Supplier Terms: You agree to abide by the terms and conditions of each Supplier. These terms may affect your booking, payment, changes, and cancellations.
7.3. Force Majeure: We will not be liable for any failure to perform our obligations, or any loss or damage you may suffer, if such failure or loss is caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, natural disasters, strikes, government actions, epidemics, pandemics, or severe weather conditions ("Force Majeure").
7.4. Limitation of Liability: To the maximum extent permitted by law, Devine Travel's liability to you for any claim arising out of or in connection with these Terms or your booking shall be limited to the amount paid by you to us for the specific booking in question. We will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits or loss of business opportunity.
8. Consumer Protection
Specific parts of your booking may be protected by Suppliers individual protections including ATOL in the UK. Devine Travel do not offer any protections on your booking.
9. Complaints and Dispute Resolution
9.1. Reporting Complaints: If you have a complaint about our services or the services of a Supplier, please notify us in writing as soon as possible, ideally while you are still travelling. This allows us to investigate and attempt to resolve the issue promptly.
9.2. Escalation: If a complaint cannot be resolved directly, and if your booking is covered by a consumer protection scheme (like ATOL), you may be able to refer the matter to the relevant scheme administrator.
9.3. Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.
9.4. Jurisdiction: Any disputes arising from these Terms or your booking shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Privacy Policy

11. Amendments to Terms
We reserve the right to amend these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the revised Terms.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with any booking confirmation and any other documents explicitly incorporated by reference, constitute the entire agreement between you and Devine Travel concerning your travel arrangements and supersede all prior or contemporaneous communications, agreements, and understandings, whether oral or written.
